Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Netherlands. Any disputes arising from or in connection with these Terms shall be exclusively resolved in the competent courts of the Netherlands.
Payment and Refund Policy
Payments for the DNA comparison service can be made via PayPal or bank transfer upon request. No additional transaction or currency exchange fees apply. Refunds are only issued in the event of an error or processing failure caused by the DNA Database for Gypsy Horses. No refunds will be given if no match is found, as the service fee covers the DNA comparison process, not the outcome. Customers must provide a complete DNA profile for processing. Partial profiles, manually typed markers, or incomplete submissions will not be accepted.
Ownership of DNA Data & Intellectual Property
The horse owner retains full ownership of the DNA profile they submit. By submitting a DNA profile, the owner grants the DNA Database for Gypsy Horses permission to store and use the profile for DNA comparison and parentage testing. DNA profiles are not shared with third parties without the owner's explicit consent. Owners may request a copy of their submitted DNA profile at any time.
Data Deletion Requests
Owners may request the removal of their horse’s DNA profile and related information from the database at any time.
Deletion requests must be made in writing via gypsyhorse-dna@outlook.com and will be processed within a reasonable timeframe.
Service Availability & Downtime
The DNA Database for Gypsy Horses does not guarantee uninterrupted access to the service. If the database is temporarily offline due to maintenance or unforeseen circumstances, no compensation will be provided. If a technical issue prevents a DNA comparison from being completed, the user will be offered a free retry once the issue is resolved.
Limitation of Liability & Indemnification
The DNA comparison results provided are for informational purposes only and should not be considered official proof of parentage. The DNA Database for Gypsy Horses shall not be held liable for errors, inaccuracies, or misinterpretations of the DNA results. Users acknowledge that genetic similarities between horses may occur without direct parentage, and official verification through a certified laboratory is recommended. Users agree to waive any legal claims against the DNA Database for Gypsy Horses, its owners, and its operators for any losses, damages, or disputes arising from the use of this service.
Changes to Terms & Conditions
We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website. Continued use of the service constitutes acceptance of the updated Terms.
